Terms and Conditions of Sale

1. Enquiries and quotations

Product information on this website is provided for general guidance and does not constitute an offer to sell. Enquiries submitted through the site are requests for a quotation, not orders. Prices, availability and lead times are confirmed in a written quotation, which is valid for the period stated on it.

We acknowledge every enquiry within one business day. A quotation is only binding once issued by us in writing.

2. Orders and acceptance

An order is accepted, and a contract formed, only when we confirm it in writing. We may decline or cancel an order before acceptance. Any variation to an accepted order must be agreed in writing by both parties.

3. Product information and specifications

Specifications, drawings and datasheets published on this site are indicative and are confirmed by the supplier at quotation stage. You are responsible for verifying that a product is suitable for your intended application before ordering. Where a specific standard, material or certification is required, this must be stated in your enquiry and confirmed in our quotation.

The manufacturer’s installation, operation and maintenance documentation supplied with each product is authoritative and supersedes any indicative information shown here.

4. Prices and payment

Prices are those set out in our written quotation and exclude VAT, duties, carriage and any other charges unless stated otherwise. Payment terms are as stated in the quotation or order confirmation. Goods may remain our property until payment is received in full.

5. Delivery and risk

Unless the quotation states otherwise, goods are supplied Ex Works (EXW, Incoterms 2020) at the agreed dispatch point. Risk in the goods passes to you when they are made available for collection. Carriage, insurance, export and import formalities, duties and taxes are your responsibility. Delivery dates are estimates given in good faith and are not guaranteed, and we are not liable for delays outside our reasonable control.

6. Warranty

Goods are covered by the manufacturer’s warranty. We pass through the benefit of that warranty to you to the extent we are able. We do not give any additional warranty beyond the manufacturer’s terms and the non-excludable rights provided by applicable law.

7. Limitation of liability

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Subject to the above, our total liability arising out of or in connection with any contract, whether in contract, tort (including negligence) or otherwise, is limited to the price paid for the goods giving rise to the claim. We are not liable for any indirect or consequential loss, or for loss of profit, revenue, production or business interruption.

8. Intellectual property

All content on this website, including text, images and graphics, is the property of EAP Global Limited or its licensors. Third-party trademarks and certification marks are the property of their respective owners and are used for identification purposes only.

9. Data protection

We process personal data in accordance with our Privacy Policy.

10. Governing law

These terms and any dispute arising from them are governed by the laws of Malta. The courts of Malta have exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

11. Changes to these terms

We may update these terms from time to time. The version in force is the one published on this page at the date of your enquiry or order.
